1.1 Smart Reviews is a software-as-a-service (SaaS) product owned and operated by Wolf IQ Pty Ltd (ABN: 36 169 796 221) (“Wolf IQ,” “we,” “us,” or “our”).
1.2 These Terms govern your access to the Smart Reviews platform, including reputation management tools, automated SMS/email sequences, AI-driven responses, and website widgets (the “Services”).
1.3 By signing up or using the Services, you agree to be bound by these Terms and the parent company’s broader legal framework.
2.1 Plan Details: The "Risk-Free Plan" is billed at $299/month (inc. GST) with no lock-in contracts.
2.2 30-Day Money-Back Guarantee: If you are unsatisfied within the first thirty (30) days of your initial subscription, you are entitled to a full refund of the first month's fee and any setup fees paid.
2.3 Retention of Reviews: Upon cancellation or refund under the 30-day guarantee, you retain ownership and use of any reviews collected on third-party platforms (e.g., Google, Facebook) during the service period.
2.4 Payment: Payments are processed via Stripe. You authorise Smart Reviews to charge your card on file automatically each month. Overdue accounts exceeding 30 days may result in service suspension.
3.1 Review Automation: Smart Reviews provides tools to automate invitations via SMS and email. You represent that you have obtained the necessary consent from your customers to contact them for these purposes in compliance with the Spam Act 2003 (Cth).
3.2 AI Responses: The Service includes AI-driven automated responses to reviews. You acknowledge that AI-generated content may not always be accurate. You are responsible for monitoring and evaluating these responses to ensure they meet your business standards.
3.3 Fair Use: While "Unlimited" requests are offered, use is subject to a Fair Use policy to prevent system abuse or prohibited spamming. Smart Reviews reserves the right to throttle or suspend accounts that negatively impact platform integrity.
4.1 Ownership: You retain ownership of all "Client Data" (customer lists, contact info). You grant Smart Reviews a license to use this data solely to provide the Services.
4.2 Security: Data is secured using 128-bit SSL encryption and stored via Google Cloud with 90-day retention for disaster recovery.
5.1 Third-Party Platforms: Smart Reviews is not responsible for the policies or actions of third-party review sites (Google, Facebook). Changes to their APIs or terms may impact Service functionality.
5.2 Liability Cap: To the extent permitted by the Australian Consumer Law, our total liability is limited to the amount paid by you in the 12 months preceding the claim.
5.3 Governing Law: This agreement is governed by the laws of New South Wales, Australia. Any disputes shall be resolved via mediation in Sydney.
